FINANCE DEPARTMENT

RESOLUTION 2009-186 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY ADOPTING THE 2010 OPERATING BUDGET FOR THE AUTHORITY
This resolution authorizes the adoption of the 2010 Operating Budget. The budget will cover all operating expenses, debt service, all other required payments and meet all bond ratio coverage tests.

RESOLUTION 2009-187 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY ADOPTING THE 2010 CAPITAL BUDGET AND THE TEN YEAR CAPITAL PLAN FOR THE AUTHORITY
This resolution authorizes the adoption of the 2010 Capital Budget necessary for planning and implementing future projects. The Finance Committee has presented to the Board of the Authority a Capital Budget for the fiscal year 2010. At the end of 2009, all open commitments payable and encumbered resources will be carried forward to the 2010 Capital Budget.


POLICY & PLANNING DEPARTMENT

RESOLUTION 2009-171 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING THE EXECUTIVE DIRECTOR TO APPROVE AND EXECUTE GRANTS AND DOCUMENTS ON BEHALF OF THE AUTHORITY WITH RESPECT TO THE AUTHORITY’S TRANSPORTATION SERVICES DEPARTMENT
This resolution authorizes the Executive Director to approve and execute grants and documents with respect to the Transportation Services Department for the period of January 1, 2010 through December 31, 2010 for additional funding issued by the Federal Government, State of New Jersey and the counties or other private sector grants. The execution of additional funding is to be conclusive evidence of the Executive Director’s authorization and approval thereof.

RESOLUTION 2009-172 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING THE EXECUTIVE DIRECTOR TO APPROVE AND EXECUTE DOCUMENTS ON BEHALF OF THE AUTHORITY WITH RESPECT TO THE SOUTH JERSEY TRANSPORTATION PLANNING ORGANIZATION
As host agency to the South Jersey Transportation Planning Organization, the Authority regularly enters into agreements to accept FHWA funds on their behalf. This resolution authorizes the Executive Director, for the period of January 1, 2010 through December 31, 2010, to approve on behalf of the Authority each Federal Aid Agreement issued by the State, to request reimbursement of eligible costs under each Federal Aid Agreement, accept reimbursement thereof and execute sub-contracts with sub-regions, consultants or other parties as may be provided for in an approved Federal Aid Agreement. The Executive Director’s execution of any documents required in connection therewith is conclusive evidence of such authorization and approval.

RESOLUTION 2009-173 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING THE AMENDMENT OF THE AUTHORITY BY-LAWS
The Authority desires to amend its By-Laws to describe the role of the Board of Commissioners on issues related to organizational structure, equal employment opportunity, labor negotiations, employment status and adds language to implement Resolution 2009-90 regarding appointment of a Deputy Treasurer and Assistant Secretary.

RESOLUTION 2009-174 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING THE PROMULGATION IN THE NEW JERSEY REGISTER OF A READOPTION AND AMENDMENT OF THE RULES AND REGULATIONS FOR THE ATLANTIC CITY EXPRESSWAY AS CODIFIED AT N.J.A.C. 19:2-1 ET SEQ.
The Atlantic City Expressway regulations (N.J.A.C. 19:2) are current, but are set to expire on May 26, 2010. The proposed changes are administrative in nature and include more definitions for clarity and language to incorporate changes in technology since the last update of the regulations. The changes proposed will allow the Authority to accept electronic bids and would allow the Authority to satisfy its obligation to advertise for projects by electronic means. The Rules and Regulations are scheduled to be published in the Register on February 1, 2010, the comment period will end April 8, 2010 and will be presented for approval at the April 20, 2010 Board Meeting.

MARKETING & COMMUNICATIONS DEPARTMENT

RESOLUTION 2009-175 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING EXPENDITURES FOR ADVERTISING
This resolution will dedicate funds for the purpose of promoting Authority core functions and commercial scheduled airline passenger traffic at the airport. Increasing passenger and airline traffic at the airport will generate income to the airport. An Advertising Plan for the Authority is researched and developed utilizing a mix of print and electronic media. The Advertising Plan includes three primary market areas: Philadelphia, Central/Northern New Jersey and Atlantic City/Southern New Jersey. Tracking programs are implemented within budget constraints and advertising development is done through the Authority’s Marketing & Communication Department and not through any advertising agency. The Executive Director signs all advertising insertion orders and ads are placed and monitored through the Marketing & Communications Department. The budget amount for 2010 advertising for the Authority and Atlantic City International Airport is in the amount of $525,000.00.

RESOLUTION 2009-176 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING EXPENDITURES FOR AIR SERVICE DEVELOPMENT
Marketing funds exist to attract new air carriers and expand new and existing air service to new city destinations. Marketing offers air service providers funds for joint marketing efforts to launch and ramp up the introduction of new air service not currently provided to the airport market for one year of jet service with the option by the Authority to provide marketing support for each year of continued operation. The Marketing Cooperative Program budget allows the Marketing & Communications Department to fund up to $50,000.00 for the first new city introduced by an existing or new air carrier and up to $25,000.00 for each additional new city currently not served at the airport.

ENGINEERING & OPERATIONS DEPARTMENT

RESOLUTION 2009-177 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING CHANGE ORDER NO. 2 TO THE CONTRACT WITH R.E. PIERSON CONSTRUCTION COMPANY OF PILESGROVE, NEW JERSEY FOR PARKING LOT IMPROVEMENTS AT THE FARLEY SERVICE PLAZA
Approval of Resolution 2009-14 authorized a contract with R.E. Pierson of Pilesgrove, New Jersey for the reconfiguration and resurfacing of the Farley Plaza Service Area parking lot. The purpose of this resolution is to authorize a change order to the existing contract. This change order is for the relocation of the fiber optic line, additional asphalt quantities to widen ramps, rewiring of the pole-mounted lights in the parking lot to meet code and additional stop bars and pavement markers throughout the parking lot to enhance the safety of drivers and pedestrians. Change Order No. 2 is in an amount not to exceed $81,196.76.

RESOLUTION 2009-178 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING AWARD OF A CONTRACT TO MARTELL CONSTRUCTION COMPANY OF PENNS GROVE, NEW JERSEY FOR THE TERMINAL DOOR REPLACEMENT AT THE ATLANTIC CITY INTERNATIONAL AIRPORT
On October 23rd and 24th, 2009, the Authority publicly advertised for bids for the replacement of the terminal doors at the Atlantic City International Airport. On November 17, 2009, four (4) bids were received, opened and tabulated. Martell Construction Company of Penns Grove, New Jersey was deemed the lowest responsible bidder in an amount not to exceed $401,734.00. This project consists of the demolition, removal and replacement of the existing main entrance doors to the Airport Terminal.

RESOLUTION 2009-179 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING A UTILITY WORK ORDER TO ADESTA COMMUNICATIONS, INC. OF SOUTH PLAINFIELD, NEW JERSEY
Resolution 2009-11 authorizing approval of the 2009 Capital Budget and Ten-Year Plan includes the development of the Course Wave Division Multiplexing Network. To complete this project, the Authority desires to issue a utility work order to Adesta Communications, Inc. of South Plainfield, New Jersey in an amount not to exceed $234,936.29. This utility work order includes constructing a fiber optic lateral from the Atlantic City Expressway to the East Maintenance and West Maintenance facilities. The construction of a fiber optic lateral will provide connectivity to the facilities, as well as, the Weather Stations being constructed at nearby locations and fiber optic access planning and design. Adesta Communications, Inc. is solely authorized to maintain repair and work on consortium built and owned fiber optic cables existing within the Expressway right-of-way and throughout New Jersey.

RESOLUTION 2009-180 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY SUPPORTING THE DEVELOPMENT OF THE SOUTH JERSEY TRAFFIC OPERATIONS AND PUBLIC SAFETY COMMAND CENTER AT THE ATLANTIC CITY INTERNATIONAL AIRPORT
This resolution memorializes the support of the Board of Commissioners for SJTA as a leader in the effort of consolidated services through development of the South Jersey Traffic Operations and Public Safety Command Center (TOPSC2) project at the Atlantic City International Airport.

AIRPORT DEPARTMENT

RESOLUTION 2009-181 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING EXTENSION OF THE CURRENT LAND LEASE WITH THE DEPARTMENT OF TRANSPORTATION FEDERAL AVIATION ADMINISTRATION
The Authority is seeking a lease modification to the current land lease with the Department of Transportation Federal Aviation Administration (FAA). The current lease has an initial term of fifty (50) years of which eleven (11) years have already lapsed. However, the lease agreement further provides that the parties may at any time negotiate an extension to the terms of the agreement for an additional fifty (50) years by written modification. The Authority is looking to develop a 13.5 acre site of land leased from the FAA by the airport. In order to do this, the Authority and the FAA have agreed to a lease modification which entails a fifty (50) year extension of the 13.5 acre site only. This will allow the term of the 13.5 acre site of the land leased from the FAA to be approximately eighty-nine (89) years in length. This extension will begin the process to develop the 13.5 acre site regarding the Airport Compatible Development RFP for the Atlantic City International Airport which will include the development of a hotel/conference center and other commercial uses on the property.

RESOLUTION 2009-182 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING AWARD OF A CONTRACT TO ARGUS DEVELOPMENT CORPORATION, INC. OF VENTNOR, NEW JERSEY FOR CONSTRUCTION AND OPERATION OF A HOTEL/CONFERENCE CENTER AND OTHER COMMERCIAL LAND USES AT THE ATLANTIC CITY INTERNATIONAL AIRPORT
The Authority is looking to expand and develop a 13.5 acre site of land leased from the Federal Aviation Administration (FAA) by the airport. It was determined that a hotel/conference center and other commercial land uses would be beneficial for the airport, as well as, the surrounding community. Consequently, the Authority sought proposals regarding the development of a 13.5 acre site of land leased from the Federal Aviation Administration (FAA). The Consultant Selection Committee met on September 6, 2007 to rank the proposals. It was decided that both proposers should be interviewed. On November 9, 2007, an interview was conducted with Argus Development Corporation and an interview was conducted with Acquest Development, Inc. on November 16, 2007. After the interviews, the Consultant Selection Committee selected Argus Development Corporation. Since that point, the Authority has been negotiating with Argus Development Corporation and has come to an agreement on the terms of the contract. This resolution will allow the Authority to enter into an agreement with Argus Real Estate Development, LLC to construct and operate a hotel/conference center and other commercial land uses at the Atlantic City International Airport.

RESOLUTION 2009-183 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING CHANGE ORDER NO. 1 TO THE CONTRACT WITH R.E. PIERSON CONSTRUCTION COMPANY OF PILESGROVE, NEW JERSEY FOR EMERGENCY LOADING BRIDGE CONCRETE PAD REPLACEMENT AT THE ATLANTIC CITY INTERNATIONAL AIRPORT
On September 15, 2009, the Board of Commissioners authorized Resolution 2009-148 for an emergency contract to R.E. Pierson Construction Company for loading bridge concrete pad replacement in the amount of $65,160.00. During the milling of the concrete pads, it was determined that additional milling and concrete would be needed to properly complete the replacement of the pads. Based on the unit price they bid on those items multiplied by the additional quantities needed the cost of this work will be $8,555.93.

RESOLUTION 2009-188 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING THE EXECUTIVE DIRECTOR TO AWARD A CONTRACT FOR AN EMERGENCY GENERATOR FOR THE ATLANTIC CITY INTERNATIONAL AIRPORT
There have been numerous power outages affecting flight operations at Atlantic International Airport (ACY). During a power outage at ACY, baggage screening operations and aircraft loading brides are not functional. This causes flight delays that impact the entire system. The current back-up generator only powers the minimal emergency and safety systems. Specifications for a generator sized for the expanded terminal will keep ACY fully operational in the event of a power interruption.



TRANSPORTATION SERVICES DEPARTMENT

RESOLUTION 2009-184 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING A PARKING AGREEMENT WITH DIVERSIFIED AC, LLC AT THE NEW YORK AVENUE PARKING GARAGE IN ATLANTIC CITY, NEW JERSEY
This resolution will authorize entering into a parking agreement with Diversified AC, LLC at the New York Avenue Garage that would permit weekday or week-long parking. The proposed monthly parking rate is $55.00 per month, per vehicle, for weekday parking and $68.00 per month, per vehicle, for week-long parking. The term of the agreement is for one (1) year from May 1, 2010 to April 30, 2011 with the right of Diversified to extend the agreement for up to four (4) additional one (1) year terms upon thirty (30) days written notice. The requested number of vehicles to be parked is between eleven (11) and one hundred (100) per month with additional vehicles only permitted upon the mutual agreement of the parties.

RESOLUTION 2009-185 OF THE SOUTH JERSEY TRANSPORTATION AUTHORITY AUTHORIZING A PARKING AGREEMENT WITH ATLANTIC PIER ASSOCIATES, LLC d/b/a THE PIER SHOPS AT CAESARS FOR THE LEASE OF PARKING SPACES AT THE FAIRMONT AVENUE PARKING LOT IN ATLANTIC CITY, NEW JERSEY
This resolution will authorize a parking agreement with Atlantic Pier Associates, LLC d/b/a The Pier Shops at Caesars (“The Pier Shops at Caesars”) who presently use the Fairmont Avenue parking lot for truck staging pursuant to an agreement with the Authority that expires on December 31, 2009. The Authority and The Pier Shops at Caesars desire to continue their parking arrangement pursuant to a new parking agreement for an additional one (1) year term whereby The Pier Shops at Caesars will lease from the Authority approximately one hundred five (105) auto parking spaces, for the purpose of parking up to, but not in excess of thirty-five (35) trucks at the Fairmont Avenue parking lot during the early morning hours specified in its loading plan for the The Pier Shops at Caesars for the monthly fee of $2,500.00. The new parking agreement will provide the right of The Pier Shops at Caesars to extend the term of the new parking agreement by up to two (2) additional one (1) year terms pursuant to the same terms and conditions as the initial term.
